Man allegedly fails to pay back funds

One local residents alleged made “empty promises” to pay back money have led him to face judicial action.

Bryan C. Pierce, 28, of 5918 Route 349 Westfield, has been charged with one misdemeanor count of theft by deception by city police.

On July 15, Stephen Martin of United Check Cashing, located at 451 Hepburn St., reported that a former customer had allegedly cashed an $800 check at the business and refused to repay the funds after a hold was placed on the check.

According to police, on April 23, Pierce had cashed an $800 check from Bears Auto Recycling in Harrison Valley. Employees at the business would later learn that a “stop payment” notification had been placed on the check.

They contacted Larry Metcalf, of Bear’s Auto Recycling, who explained that Pierce had tried to sell Metalf a Dodge truck. However, when Pierce failed to return to the business with the title of the vehicle, Metalf called his bank and had them put a hold on the check, according to court records.

Martin contacted Pierce, who allegedly promised to repay the $800, according to the affidavit.

Police noted that “these empty promises went on for two weeks,” before Martin became frustrated enough to call authorities.

Pierce was arraigned yesterday before District Judge Gary A. Whiteman. He has been released on $7,500 bail.
