Ex-Clinton County warden files amended complaint

A former Clinton County Correctional Facility warden who believes he was wrongfully terminated from his job five years ago has filed a second amended complaint in U.S. Middle District Court.

Thomas Duran’s contract was terminated effective Nov. 5, 2012, after the county prison board voted to suspend the long-time prison administrator. Duran was 55 at the time and had undergone surgeries to repair his knees, legs and ankles, according to the complaint.

His contract was for five years from Nov. 5, 2007 through Nov. 4, 2012 and was not renewed by commissioners. Duran’s second amended complaint arises from the alleged wrongful termination of employment. He is pursuing civil action against Commissioners Jeffrey Snyder, Robert Smeltz and Joel Lang.

The alleged wrongful termination of Duran’s employment at warden was pursuant to enforcement provisions of laws regarding family and medical leave, Americans with disabilities and age and discrimination in employment, according to Duran.

The commissioner’s counsel argues that age and disability played no part in the decision to not renew Duran’s contract, which counsel says was related to job performance.

The matter is to be decided by Judge Christopher C. Conner.
