Acting against terror

As the question of how to try Dzokhar Tsarnaev is discussed, it begs for an answer to the question of what kind of war on terror we’re fighting. Terrorists have declared war on us, but as far as I’ve been able to determine, we haven’t legally declared war on terrorists. Does that make the terrorist bombings criminal activities requiring the reading of Miranda rights and a civil trial instead of an act of war?
