Police: Hit-and-run driver objects to DUI charge because she ‘did the drugs yesterday’

By PHILIP A. HOLMES - pholmes@sungazette.com
POSTED: April 10, 2009

MUNCY - When alleged hit-run driver Marina Digenakis was taken into custody on the afternoon of Feb. 10 for driving under the influence, she appeared a bit confused, borough police said.

There was no evidence of alcohol in her system, but she was "very unstable" as she walked around her car, borough police Sgt. James W. Dormin said in an affidavit. Her eyes were glassy and bloodshot, and she failed a series of sobriety tests, the officer said.

"I don't know how I can be arrested for being under the influence when I did the drugs yesterday," the 26-year-old woman allegedly told the officer.

When Dormin asked her what drugs she took, Digenakis told him that she used "marijuana, cocaine and heroin" on Feb. 9, according to the officer's affidavit.

Digenakis of 111 S. Market St. allegedly sideswiped a parked car with her vehicle near Main and Water streets about 2:45 p.m., Dormin said. She kept going, but the driver of the parked vehicle followed her a short distance before she pulled over.

When she stopped, her car struck the curb, deflating one of her front tires, Dormin said. A blood test revealed cocaine allegedly was in her system at the time of the crash, the officer said.

Charged with driving under the influence of a controlled substance and hit-run, Digenakis has been sent a summons to appear before District Judge C. Roger McRae.
