District Judge James Carn this week dismissed a city police charge of convicted felon not to possess a firearm against Eric Ray Jolin, 26, of 2348 Newberry St., following a preliminary hearing Tuesday.
Carn threw out the case, saying there was insufficient evidence presented at the hearing to support the allegation.
Jolin was arrested on Jan. 8 after a parole officer discovered seven long guns inside Jolin's house, police said. On state parole for a drug conviction, Jolin was permitted to stay at his father's house as long as there were no firearms in the house, police said.
After hearing the testimony, Carn ruled the incident was more a parole violation and not a criminal matter.
The guns belonged not to Jolin, but to his father, Carn said. The guns were in the father's bedroom.
