City man acquitted of crack cocaine dealing charge

A Lycoming County jury acquitted a 43-year-old city man of crack cocaine delivery charges last week when the prosecution's primary witness did not show up to trial.

Sean Anthony Smith, of 617 High St., was on trial for possession with intent to deliver less than a gram of crack.

The Commonwealth was prepared to argue that a confidential informant for the county's Drug Task Force called Smith to set up a deal for about $100 in drugs on April 10, 2012.

Smith and the informer allegedly met in the 400 block of Park Ave., where they went shopping at the Family Dollar. City police then pulled over the vehicle they were in and found the drugs and money.

Without the informant on the stand, the state could not meet the burden of proof and the jury acquitted Smith of all charges.
