Ex-nurse aide sues elder care facility

A former nurse’s aide at Valley View Nursing Home is suing the facility on a basis of alleged race discrimination.

Nichole Nixon of Packer Street said she was harassed while working at the facility on Warrensville Road as were other black nurses aides, according to the lawsuit in U.S. Middle District Court.

Nixon worked at the home for the elder care from 2019 to 2019. She alleged she was subjected to a hostile work environment by her superiors due to her race and unlawfully terminated, a violation of her civil rights.

Nixon has asked the court to make sure the facility adheres to a policy prohibiting discrimination and retaliation against any employees. She alleged a hostile work environment and wrongful termination.

Nixon is seeking to be compensated with any pay and for her emotional distress, the court record said.

An attorney for the nursing home said Nixon’s termination was due to her insubordination and she was a threat to the health and safety of the elderly or medically compromised residents.

Middle District Judge Matthew W. Brann has issued an order for the case to be mediated.
