At 1:45 p.m. on Oct. 14, Michael Benson, 42, of 672 1/2 Sixth Ave., was arrested by city police after he allegedly refused orders to leave by the staff at Sheetz on Maynard Street.
Benson ordered food and was inside the store for two hours, at which point, he began complaining that he had ordered three drinks, but only received one, police allege.
Benson had a strong odor of alcohol, slurred speech and interrupted police several times, court documents state.
Benson allegedly refused police orders to leave and scuffled with them as they attempted to take him into custody, according to an affidavit.
During a search, police verified Benson had paid for only two drinks, and discovered a container of marijuana prescribed in Benson’s name.
He was charged with criminal trespass, resisting arrest, disorderly conduct, possession of marijuana, possession of drug paraphernalia and a summary offense.
