Judge throws out drug charges against city man
Ruling there was insufficient evidence in the case, District Judge Christian Frey threw out all city police charges Tuesday against Harold Rainier.
Rainier, 35, of 2326 W. Fourth St., had been jailed since his arrest on Oct. 30 when police allege he threw a bag of 30 oxycodone pills underneath a parked vehicle in the 1600 block of Memorial Ave.
However, during Rainier’s preliminary hearing, it was learned that police did not actually see Rainier toss the bag that officers recovered from under the vehicle. Police also never saw him in possession of the bag.
Frey dismissed charges of possession with intent to deliver a controlled substance, possession of drug paraphernalia and tampering with physical evidence. Upon the judge’s ruling, Rainier was released from the Lycoming County Prison.
