14 charged with DUI

Derrick Day, 34, of 36 Turkey Bottom Road, Muncy, was stopped by Montoursville police at 5 p.m. on May, after they received a report of his 2010 Nissan Pathfinder repeatedly swerving onto the shoulder of the road in the area of Walnut Street and Fairview Drive.

Day had a strong odor of alcohol and three young children seatbelted in the rear of the vehicle, police allege.

Day failed to complete a field sobriety test, instead requesting an attorney, and had a BAC of .30.

He was charged with DUI, endangering the welfare of a child, a summary offense, waived his preliminary hearing and was released on $5,000 bail.

In another case, state police stopped Ernest Poole, 41, of 632 Pine St., apartment 2, after they observed his 2017 Dodge Ram 1500 ride the fog line three times before making a wide turn onto Basin Street, driving onto top of the double yellow centerline. Upon making contact with Poole, police also noted that the Pennsylvania inspection had expired.

Poole had an odor of alcohol, glassy, bloodshot eyes and related that he had consumed one alcoholic beverage earlier in the evening, police allege.

Poole failed a field sobriety test and had a BAC of .15.

He was charged with DUI, four summary offenses, waived his preliminary hearing and was released on $5,000 bail.

In another case, at 12:30 a.m. on Sept. 9, Montaysia Smith, 23, of 1904 Kenwood Ave., apartment 3, was stopped by state police after they observed one of the registration lights on his 2003 Nissan Altima to be inoperable.

Smith told police that she had not consumed any alcohol during dinner, but her passenger had.

She failed a field sobriety test, subsequently resisting police attempts to take her into custody, an affidavit said.

Once placed in handcuffs, Smith began to yell, “call my mom,” and placed her foot on the patrol car in an attempt to avoid being put inside.

Once at UPMC DUI Processing Center, Smith refused lab work.

She was charged with DUI, resisting arrest, disorderly conduct, a summary offense, waived her preliminary hearing and was released on $5,000 bail.

In another case, James Flook, 73, of 2029 Misner Road, was stopped by state police at 11 p.m. on Sept. 21, after they observed his 2009 Volvo C70 cross over the center fog line and partially enter the left lane near mile marker 28.6 on I-80 Westbound.

Flook had an odor of alcohol and glassy, bloodshot eyes, police allege.

He stated he was coming from The Eagles social club, where he had consumed one alcoholic drink, and attempted to hand police his credit card before producing his driver’s license, according to court documents.

Flook failed a field sobriety test, and had a BAC of .15.

He was charged with DUI, two summary offenses, waived his preliminary hearing and was released on $5,000 bail.

In another case, state police stopped Amy Vogt-Avila, 24, of 136 Valley St., apartment 6, DuBoistown, at 2 a.m. on Sept. 2, after they observed that the registration plate cover on her 2015 Subaru Legacy obscured the state of origin. During a check of the registration, it was revealed that it had expired in June.

Vogt-Avila had an odor of alcohol and glassy, bloodshot eyes and an odor of marijuana was detected from the vehicle, police allege.

During a consensual search of the vehicle, police discovered a joint containing marijuana and two vape pens containing suspected THC oil, court documents state.

Vogt-Avila failed a field sobriety test, had a BAC of .10 and lab results were positive for the presence of THC.

She subsequently failed to show for a preliminary hearing and a bench warrant is expected to be issued.

In another case, at 3:30 a.m. on July 5, Kaimen West, 19, of 10 W. Highland St., Avis, was stopped by state police after they observed a registration light to be inoperable on South Route 220 in the city.

West initially tried to hand police a debit card before retrieving his driver’s license and had to be asked twice for the registration and proof of insurance for the vehicle, according to court documents.

Police detected an of marijuana from the vehicle, and when questioned on this, West first told them that his grandmother possessed a medical marijuana card, before admitting to having last used marijuana himself three months prior.

During a consensual search of the vehicle, police recovered a small amount of marijuana and a grinder, an affidavit said.

West failed a field sobriety test and lab results were positive for the presence of THC.

He was charged with DUI, possession of marijuana, possession of drug paraphernalia, a summary offense, waived his preliminary hearing and was released on $5,000 bail.

In another case, Cadence Neely, 18, of 1010 Sheridan St., was arrested by state police at 12:30 a.m. on July 17, after her 2011 Subaru Impreza rear-ended another vehicle that was stopped at a red light Old Montoursville and Warrensville roads.

Neely had an odor of marijuana and glassy, bloodshot eyes and related that she sometimes uses marijuana, but had not done so in a week or two, police allege.

Neely failed a field sobriety test, and lab results were positive for the presence of THC.

She was charged with DUI, two summary offenses, waived her preliminary hearing and was released on $5,000 bail.

In another case, state police arrested Jacob Strassner, 25, of 355 Colonial Drive, Montoursville, at 12:45 a.m. on Aug. 26, after they observed his 2022 Dodge Charger parked partially on State Route 864, near its intersection with Miller Road, with Strassner next to the vehicle, appearing to be urinating.

Strassner had an odor of alcohol, glass, bloodshot eyes and admitted to having consumed alcohol prior to driving, as well as stopping at that location to urinate, an affidavit said.

Strassner failed a field sobriety test, and had a BAC of .09.

He was charged with DUI, a summary offense, waived his preliminary hearing and was released on $5,000 bail.

In another case, at 9:45 p.m. on July 2, John Rothrock IV, 24, of 104 Clees Drive, Montoursville, was arrested by state police after they observed his 2002 Chrysler Sebring cross over the fog line four times near Old Montoursville and Warrensville roads.

Rothrock had glassy, bloodshot eyes and avoided eye contact with police while attempting to remove his license from his wallet, court documents said. An odor of alcohol was also detected from the vehicle.

Rothrock failed a field sobriety test and had a BAC of .20.

He was charged with DUI, two summary offenses, waived his preliminary hearing and was released on $5,000 bail.

In another case, state police stopped Larone Kelson, 30, of 337 Walnut St., apartment 1D, at 1:45 p.m. on Oct. 22, after they observed his 2018 Kia SUV traveling along East Third Street with no headlights illuminated.

Kelson had a strong odor of alcohol, failed a partial field sobriety test and refused lab work, according to court documents.

He was charged with DUI, two summary offenses, waived his preliminary hearing and was released on $5,000 bail.

In another case, Janet Hampton, 62, of 161 Confair Parkway, Montoursville, was arrested by state police at 5:30 on Sept. 27, after her 2016 Mazda struck another vehicle at Bella Vista Drive and Lycoming Mall Road. Hampton initially stopped, but then fled the scene.

Upon identifying the vehicle involved by damage to its front end, Hampton told police she had been leaving Cracker Barrel when she misjudged the turn onto Bella Vista, causing her to strike the vehicle, court documents state.

She further stated that she believed that the other driver had her information, so continued to her residence.

Hampton had an odor of alcohol and admitted to drinking prior to driving, police allege.

Hampton failed a field sobriety test and had a BAC of .17.

She was charged with DUI, five summary offenses, waived her preliminary hearing and was released on $5,000 bail.

In another case, state police stopped Sarah Taylor, 41, of 330 Tinsman Ave., at 9 p.m. on Sept. 30, near Sheridan Street and River Avenue, after a routine check revealed that the registration on her 2013 Kia Optima was under suspension.

Taylor had an odor of alcohol and watery, bloodshot eyes, and related that she believed the reason for being pulled over was because she had coasted through a stop sign, police allege.

She further stated that she was coming from a friend’s house party and admitted to consuming alcohol prior to driving, according to an affidavit.

Taylor failed a field sobriety test, and had a BAC of .08.

She was charged with DUI, two summary offenses, waived her preliminary hearing and was released on $5,000 bail.

Duron Clay, 41, of 831 Elmira St., was stopped by Montoursville Police at 1:30 a.m. on Sept. 23, after they observed his 2014 Dodge Caravan traveling in the 100 block of West Fourth Street with no lights on.

Clay had a strong odor of alcohol, glossy eyes and spoke with low, mumbled speech, police allege.

Clay initially refused to provide police with a driver’s license or ID, and asked several times why he was being stopped, despite having repeatedly been told why.

Clay refused a field sobriety test and lab work, and initially resisted police attempts to take him into custody.

He was charged with DUI and three summary offenses.

In another case state police arrested Peter Hunter, 66, of 55 Maple Lane, Muncy Valley, after his 2006 Jeep Commander was involved in a single vehicle crash in the 400 block of Lakeside Drive at 8 p.m. on June 23.

Hunter told police that he was coming home from a friend’s house when he attempted to make a sharp right turn onto Maple Lane when his front driver’s tire went over an embankment, causing the vehicle to crash.

Hunter, whose right eye was covered due to a medical ailment, had a glassy, bloodshot left eye, slurred speech and an odor of alcohol, police allege, adding that he was very talkative throughout his encounter with police.

He admitted to having consumed three cocktails prior to driving and had a BAC of .17, according to court documents.

Hunter was charged with DUI and two summary offenses.
