TOWANDA – Daryl Lynn Barnes Jr., 51, of 33 Hillside Acres Trailer Court, Gillett, was charged by state police Wednesday in the shooting death of his brother, Fred Orson Barnes, 46, of Elmira, New York, Tuesday night.
According to state police, at about 8 p.m. Tuesday, a physical altercation between the two men occurred at the Daryl Barnes’ Ridgebury Township residence in Bradford County after Fred Barnes allegedly showed up intoxicated.
Fred Barnes went to the residence to get his belongings from a utility room on the property, according to police. When Daryl Barnes confronted him, Fred allegedly grabbed his brother and began “slamming his head into a wall by his neck,” police said.
Daryl Barnes then retrieved a loaded 20-gauge Mossburg bolt-action shotgun and “pushed the barrel into Fred Barnes’ lower chest area,” police said.
Fred Barnes then told his brother he was going to have to shoot him, according to police.
Daryl Barnes told police his finger was on the trigger and the gun “went off,” striking Fred Barnes in the chest.
Fred Barnes was transported to Robert Packer Hospital in Sayre, where he died from his injuries.
Bradford County Coroner Dan Carman pronounced Fred Barnes dead at about 4 a.m. Wednesday morning and ruled the manner of death homicide, pending further post-mortem examination, police said.
Daryl Barnes Jr. was charged with one count of criminal homicide, arraigned before District Judge Michael Shaw in Sayre and remanded to the Bradford County Correctional Facility without bail.
His preliminary hearing was set for June 29 before District Judge Jonathan Wilcox, of Troy.
