A Lycoming County judge has ruled that a building at 1920 Riverside Drive in South Williamsport, near the Maynard Street bridge, may be taken down after the owner appealed the demolition notice.
Judge Eric R. Linhardt, in an opinion and order, ruled in favor of the borough and against building owner Brad Gordner, the appellant in the case.
The property is at the northeast corner of Riverside Drive and South Maynard Street. It has five distinct portions that were relevant to the appeal.
The eastern segment consists of a square, paved parking lot. Directly to the west of the lot, is a single-story convenience store. The middle of five segments is a two-story residence. To the west of the house is a narrow, single-story shed overhung by an awning roof. The final part of the property is a three-story structure called the Protasio Building.
Gordner has stated the building can be rehabilitated, but does not explain why that would invalidate the borough's action.
Gordner asked the court to graft a condition onto the amendment, holding that the borough may demolish a blighted property unless that property can be rehabilitated.
The amendment does not include such a condition and the court declined the invitation to impose it. Also, Lindhardt determined the notice of demolition was not arbitrary or unreasonable.
