Withdrawn charges refiled against Mirabito

Just a little more than 14 hours after charges against Rick Mirabito were withdrawn, Williamsport police refiled the very same charges against the former Lycoming County commissioner.

Accompanied by his attorney, Mirabito, 67, of Cogan Station, surrendered at the office of District Judge Christian Frey about 9:30 a.m. Wednesday to face felony charges of burglary and trespassing plus a misdemeanor charge of theft.

Mirabito made no statements during the proceeding and was released on $10,000 bail.

Police allege in the complaint that he illegally evicted tenant Joyleen McClements from her apartment at 1005 Vine Ave., a building Mirabito owns, on New Year’s Day by entering her apartment and taking her keys to the unit as well as the building.

“No one is above the law,” District Attorney Tom Marino told the Sun-Gazette Wednesday morning.

Marino said he initially withdrew the charges Tuesday due to concerns his office did not have enough information about the incident and noted the incident’s connection to an underlying landlord-tenant dispute, an area of jurisprudence generally separate from criminal prosecutions.

“My office is not in the landlord-tenant business,” he said.

Still, he said, there are clear procedures and practices for a landlord to pursue eviction before a district judge.

“There is a right way to do things,” Marino said.

A preliminary hearing has been scheduled at Frey’s office on Jan. 16.
