An amended petition was filed this week in county court by Lycoming County Controller Krista Rogers, seeking a payment of $120,111 to cover costs resulting from her successful legal battle with the county commissioners over who has the responsibility for certain fiscal functions, according to a story from PennLive.
When contacted by the Sun-Gazette, Rogers said that the attorneys have been talking and "we are hopeful for an amicable resolution."
The filing was to preserve the issue, Rogers said.
PennLive reported Matthew McDermott, director of administration for the county, said that the commissioners will review Rogers' petition to ensure the fees are reasonable.
The legal battle between the commissioners and Rogers began in 2021 when the board of commissioners at that time transferred the general ledger, payroll and accounts payable functions to their Office of Budget and Finance where they had been prior to 2019 when Rogers had asked that they be transferred to her office.
The commissioners had cited dissatisfaction with the way work was being done in the controller's office as the reason for the return of the functions and the staff to do them.
The current commissioners decided not to appeal a Commonwealth Court decision in January which stated that the fiscal functions belonged in the controller's office.
The appellate court affirmed the decision of Potter County Senior Judge John B. Leete who had ruled three times that the County Code assigned those functions to Rogers' office, PennLive said.
Leete has also awarded Rogers the cost of her litigation.
