Hughesville McDonalds managers charged after alleged theft, fabricated robbery
HUGHESVILLE — Two managers at McDonald’s on Route 405 have been arrested on felony charges for allegedly stealing an estmated $5,400 from the restaurant’s safe, according to state police.
Robert Eugene Foran, who has since been terminated from his position, and Sierra Nichole Smith, 26, both face charges of theft by failure to make required disposition of funds, theft by deception and theft.
Foran, 34, of 176 S. Main St., Picture Rocks, faces an additional misdemeanor charge of false reports for fabricating a story about being robbed of a deposit bag outside the restaurant about 6 a.m. on Jan. 6, Trooper David Batkowski, the lead investigator, alleged in an affidavit.
“Foran admitted to making up the story about him being robbed to cover the money missing from the safe,” the criminal investigator said.
“Foran related that he borrowed about $500 from the safe and Smith borrowed approximately $300. He later admitted that the borrowing snowballed, and that he lost track (of how much was actually taken from the safe), Batkowski said.
A unit supervisor “sent Foran a picture of the missing deposits, and he saw that it was about $5,426,” he said.
Batkowski said Foran told him “Yep, I made the stupidest choice,” it was stated in affidavit. “It is against store policy to borrow from the safe,” the investigator said.
Despite that policy, Smith, of 1635 Route 442, lot 11, told investigators that “Foran told her she was allowed to borrow from the safe, but that she had to pay it back. She also was aware that Foran was borrowing too,” it was stated in the affidavit.
Smith told Batkowski that “sometime in November or December, she noticed thousands missing from deposits, and notified Foran, who told her that he did not know where the money went. Smith was confused as to why Foran was not checking cameras to find out,” it was stated in the court document.
“Smith said she and Foran would combine money from bank deposits meant for different dates to cover for the missing money,” the court document stated.
Although she admitted to “borrowing about $300 from the safe,” she was “willing to contribute $1,000 from her tax return (to cover the missing funds),” the affidavit stated.
When Batkowski asked her why she was willing to give $1,000 if all she borrowed was $300, Smith replied that “she just wanted everything to be over with and the safe count to be right,” it was stated in the affidavit.
When Foran and Smith were discussing with one another on “how to fix the safe count, Foran talked about wishing that they just got robbed, but Smith thought he was joking,” according to Batkowski.
Foran and Smith have both been arraigned before District Judge Kirsten Gardner and released on $15,000 bail each. Foran has since waived his preliminary hearing while Smith’s preliminary hearing is scheduled next week.
